Dr. Richard Toussaint, co-founder of the now-bankrupt Forest Park Medical Center in Dallas, has been found guilty on seven counts of health care fraud by a federal jury in Dallas, according to a news report.

Toussaint, an anesthesiologist, was found guilty of submitting fake invoices in 2009 and 2010 to several insurance companies and a federal health benefits program for services he did not provide. He also inflated the time it took to perform the procedures and pre-signed patient records to reflect that procedures took place.

In 2013, Forest Park Medical Center paid over $258,000 to settle allegations that it paid kickbacks to local doctors for patient referrals between 2008 and 2012. Forest Park filed for bankruptcy in February 2016 and has several locations in North Texas, including Frisco, Southlake and Fort Worth.

Toussaint was originally indicted on 17 counts of health care fraud in May 2015. He was accused of submitting more than $5 million in false claims to United Heallthcare, Blue Cross Blue Shield of Texas and the Federal Employees Health Benefits Program in 2009 and 2010.

According to the indictment, the government alleged that Toussaint billed the health insurers for procedures he did not perform. The U.S. Attorney said that when those procedures were conducted, Toussaint was either out of the state or working at another location. Toussaint also practiced medicine at Doctors Hospital in Dallas.

The indictment also alleged that Toussaint pre-signed medical records that represented services he had not yet performed and instructed others to do the same. In addition, he was accused of overstating the time it took for him to perform the procedures.

Toussaint faces up to 10 years in federal prison and a fine of up to $250,000 for each of the seven counts. He also has to pay restitution and forfeit any property acquired with the proceeds from the fraud, which totaled $10 million.
