The trial of a former Rockwall physician began in federal court recently amid allegations that he was the mastermind behind a massive Medicare home health care fraud scheme that resulted in bogus home health care services claims worth $375 million. Former doctor Jacques Roy, age 56, allegedly developed the scheme after his medical license was suspended and he was having difficulty finding work. Roy is accused of having recruited an estimated 11,000 fake patients, including members of Dallas's homeless population, to submit fake Medicare claims, in exchange for promises of food stamps, cash, and groceries. Over a period of five years, Roy alleged treated more patients than any other doctor's office in the country. According to federal authorities, Roy single-handedly orchestrated the largest home health fraud scam in history. Six others also were arrested and charged with Medicare fraud. Three of those individuals have confessed and are expected to testify against Roy at the trial, which may last as long as a month.
Federal charges of home health care fraud are no laughing matter, as Roy has already learned. Roy has been incarcerated since his arrest in 2012, and he has not even yet been convicted. Roy has no bond, based on allegations of federal authorities that he was a flight risk, since they found evidence that he had hidden money offshore under another name and planned to assume a fake identity and flee. He potentially faces more years in prison if he is convicted. Authorities also have frozen more than four million dollars of the estimated $19 million in assets that Roy reaped from his alleged scam.
Although Roy appears to be embroiled in a very complex scheme of health care fraud that developed over a number of years, he is still entitled to a strong defense in an attempt to minimize the penalties in the event that he is convicted.
