Dallas Anesthesiologist Charged With 17 Counts of Health Care Fraud

Dr. Richard F. Toussaint Jr., a Dallas anesthesiologist, has been indicted on 17 counts of health care fraud by a federal grand jury.

Toussaint, who is co-founder of Forest Park Medical Center and Ascendant Anesthesia, is accused of submitting more than $5 million in false claims to United Heallthcare, Blue Cross Blue Shield of Texas and the Federal Employees Health Benefits Program in 2009 and 2010.

According to the indictment, the government alleges that Toussaint billed the health insurers for procedures he did not perform. The U.S. Attorney said that when those procedures were conducted, Toussaint was either out of the state or working at another location. He also practiced medicine at Doctors Hospital in Dallas.

The indictment also alleges that Toussaint pre-signed medical records that represented services he had not yet performed and instructed others to do the same. In addition, he is accused of overstating the time it took for him to perform the procedures.

Toussaint will plead not guilty to all the charges. He is no longer in practice at Ascendant Anesthesia.

If he is convicted, Toussaint faces 10 years in federal prison for each count of health care fraud as well as a $250,000 fine and would potentially have to pay restitution.
